労務の知識＜2＞　脱退一時金

　前回の「産後パパ育休」（出生時育児休業）についてのコラムはいかがでしたでしょうか？ 新たな制度が出来ると、それを従業員の方々に周知し、運用していくことが大切ですね。

　今回は、外国人従業員に関連する「脱退一時金」についてお伝えしていきたいと思います。社会保険に加入していると、厚生年金保険料を支払いますが、外国人従業員の方は、老齢年金の受給資格を得ないまま、帰国される場合もあると思います。その場合は、請求することで「脱退一時金」を受け取れる可能性があります。これは、厚生年金保険だけでなく、国民年金や共済組合等に加入していた場合にも適応されます。外国人従業員の方にとっては、老齢年金を貰えないのになぜ厚生年金保険料が天引きされるのか納得いかないかもしれません。しかし、厚生年金保険はじめとする、これらは年金保険ですので、一定の要件を満たすことにより、老齢だけでなく、障害や死亡の際には障害年金（又は障害手当金）や遺族年金等が支給されます。今回は、厚生年金保険加入を前提とした知識を会話形式でお伝えさせていただきます。

Male Employee＜以下、M＞：I will be going back to my home country, Malaysia, next month.

Human Resources＜以下、H＞：Oh, really? I am going to miss you.

M：I am going to miss you, too. I love Japan very much.
By the way, I have been paying the Employees’ Pension Premium since I came to Japan,but I have heard that I can get a lump-sum payment by filing a claim.
（私も淋しいです。日本がとても好きでしたので。
ところで、日本に来てから厚生年金保険料を支払ってきましたが、請求することによって一時金が受け取れると聞きました。本当ですか？）
H：You are right. That is “Lump-sum Withdrawal Payment’. But you need to meet the requirements. How long have you been transferred in Japan?
（そうです。それは、「脱退一時金」と言います。但し、条件がありますが、あなたは日本に来て何年ですか？）
M：5 years.（5年です。）
H：I see. The person who has paid the Employee’s Pension Premium for six months or more and has never had the right to receive a pension (including disability allowance) can claim for a Lump-sum Withdrawal Payment.
You are from Malaysia, right? As Malaysia is not a partner country that have signed the Social Security Agreement in regard to the International Transferable Pension System and Totalization of Coverage Periods, the period of pension enrollment in Japan will not be counted. Therefore, you can claim for a Lump-sum Withdrawal Payment because you do not meet the eligibility period for the old-age pension in Japan and has paid premium for more than 6 months.
（分かりました。厚生年金保険料を6月以上支払い、年金（障害手当金を含む）を受ける権利を有したことがなければ、請求が可能ですよ。 あなたはマレーシア出身でしたよね。マレーシアは、日本と年金通算の社会保障協定を締結していないので、日本での年金加入期間は通算されません。そのため、日本での老齢年金の受給資格期間を満たしていない上で6月以上保険料を支払っていますので、「脱退一時金」の請求が可能になります。 ）
M：I see.（そうですか。）
H：The amount of the Lump-sum Withdrawal Payment is calculated in accordance with the number of months of your enrollment in the Japanese pension system limited with the maximum number of 60 months. From April 2021, the maximal number of months used in the calculation of the payment amount has been raised from 36 months (3 years) to 60 months (5 years).
（脱退一時金の支給額ですが、日本の年金制度に加入していた月数に応じて、60月を上限として計算されます。この支給額計算の上限は、2021年4月から36月（3年）から60月（5年）へ引き上げられたのですよ。）
M：Oh, I see. By when should I claim a Lump-sum Withdrawal Payment?
（そうなんですね。いつまでに請求する必要がありますか？）
H：You need to claim a Lump-sum Withdrawal Payment within two years from the date you no longer had an address in Japan. If you wish to submit your “Claim for Lump-sum Withdrawal Payment” in Japan before leaving Japan, it is needed to submit your Claim to the Japan Pension Service after submitting the Moving-out Notification or after the (planned) deletion date of your residence record. This is because, as a requirement for receiving the Lump-sum Withdrawal Payment, it is necessary that you do not have an address in Japan on the day the Japan Pension Service receives your Claim.
（日本に住所を有しなくなった日から2年以内に請求する必要があります。 もし出国前に日本国内から請求書を提出する場合には、住民票の転出（予定）日以降に請求書を日本年金機構に提出する必要があります。脱退一時金の受給要件として、日本年金機構が請求書を受領した日に日本に住所を有していないことが必要だからです。 ）

H：Of course. I will check the documents required for claiming a Lump-sum Withdrawal Payment. I will come back to you later.
